OVERVIEW

This website is operated by Towers Rare Books, the trading name of Ugur Saglik, a sole trader established in the United Kingdom. "We", "us" and "our" refer to Towers Rare Books. The terms below, together with the policies referred to in them, govern your use of this website and any sale we make to you.

There is no basket and no checkout on this website, and nothing can be ordered or paid for here. Books are sold by enquiry and collected in person. Section 3 sets out exactly how a sale is made and at what moment a contract is formed.

Nothing in these terms removes or limits any right you have under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Where anything here conflicts with those rights, those rights prevail.

SECTION 1 - USING THIS WEBSITE

You may use this website if you are at least 18 years old, or old enough to enter into a binding contract where you live, whichever is greater.

There are no customer accounts on this website. You are not asked to register, to choose a password, or to give us a billing address, a card number or any other payment detail. If a page ever asks you for a card number, it is not ours: close it and write to us.

You may browse the catalogue and read the descriptions freely, whether you are a private collector, a librarian, an institution, or a member of the trade.

SECTION 2 - OUR STOCK

Our stock consists of antiquarian and second-hand books and manuscripts. Every item is a unique physical object of considerable age, catalogued individually and described as accurately as we are able.

The photographs accompanying a description form part of that description. Wear, defects, repair and restoration that are disclosed in a description or visible in the accompanying photographs are characteristics of the item as sold, and are not faults for the purposes of the Consumer Rights Act 2015, because they are specifically drawn to your attention before you buy.

Where an item forms part of a set, the description states precisely which volumes are offered. We are glad to answer questions of any level of detail, and to supply additional photographs of specific leaves at any magnification, before you commit to a purchase.

Colour reproduction varies between screens, and a photograph is not a substitute for handling the book. That is one of the reasons we sell for collection in person, and why you may examine a book at the handover for as long as you wish before completing the collection.

SECTION 3 - HOW A SALE IS MADE, AND WHEN A CONTRACT IS FORMED

The price shown on a book's page is the price at which that book is offered. It is an invitation to treat. It is not an offer that you can accept by any action on this website, and no contract is formed by your reading this website, by writing to us, or by our replying to you.

A sale is made as follows.

1. You write to us about a book. We correspond. Questions of any level of detail are welcome and are never a nuisance, and we are glad to send further photographs before you commit to anything.

2. If you decide to buy, and we are willing to sell to you, we send you a written confirmation by email. It sets out the book, the agreed price, how payment is to be made, and how collection will be arranged. It also contains the pre-contract information described below.

3. The contract between us is formed when we send that written confirmation, and not before. Nothing you say in the course of an enquiry binds you, and nothing we say binds us, until that confirmation is sent. We may decline to proceed at any point before then, for any reason, including that the book has been sold elsewhere or that we are not satisfied the sale is one we wish to make.

4. You pay the agreed price by the means set out in the confirmation. We do not take card payments and we never ask for card details.

5. Once payment has cleared we arrange collection at a time and place convenient to us both. Title and risk pass to you at the point of collection.

Your right to cancel. Because the contract is normally concluded by correspondence rather than in person, it is a distance contract, and a consumer buyer has a statutory right to cancel within 14 days. So that this is never in doubt, and whatever the circumstances in which a particular contract happens to be concluded, we grant that same 14-day cancellation right as a term of every sale we make to a consumer buyer. The Refund Policy sets out how it works, including how the period is counted, how a return is made in person, and when a refund may be reduced. This is a contractual promise in addition to your statutory rights, not a restatement of them and not a substitute for them.

Pre-contract information. Before you are bound, the written confirmation will give you the information the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 require us to give you. That includes a description of the book, the total price, the collection-only arrangement, our identity and contact details, the existence of the cancellation right with its conditions, time limit and procedure, and the model cancellation form. You do not have to use the form.

Business, trade and institutional buyers. Where you are buying in the course of a business, including libraries, institutions and members of the trade, the statutory cancellation right does not apply, and we do not grant it contractually. Our undertaking that a book is as described stands in every case, and if a book is materially not as described we will take it back and refund you in full whoever you are.

SECTION 4 - PRICES

Prices are shown in pounds sterling and are the total price payable. There is no delivery charge, because there is no delivery.

Towers Rare Books is not registered for VAT. No VAT is charged on our sales and none can be reclaimed on them.

We do not run sales, discounts or promotions. Offers on an individual book are considered on their merits; please write.

The price that applies to a sale is the price set out in our written confirmation. We may change the price shown on the website at any time before a confirmation is sent, but a change after a confirmation has been sent does not affect that sale.

SECTION 5 - COLLECTION IN PERSON

We do not offer postage, delivery or shipping of any kind. Every book is sold for collection in person, in London.

For books of this age and value we believe a face-to-face handover is the right way to sell. You may examine the binding, the paper and any inscriptions at leisure and satisfy yourself fully before the handover is completed, and we allow as much time as you need to do so. If at that point the book is not what you expected, say so, and we will refund you there and then.

Collection is arranged at a mutually convenient time and place once payment has cleared. Title and risk of loss pass to you at the point of collection.

In exceptional cases we may agree to despatch a book by separate written arrangement. It is not a service we offer as standard, it is never assumed, and it would change the terms on which the book is sold. If it is ever agreed, we will set out those terms in writing at the time. If you cannot collect in person, please say so before we send a written confirmation.

Our market is the United Kingdom and our prices are in pounds sterling, but our books are offered to collectors and institutions anywhere. The constraint is where collection happens, not who may buy.

SECTION 6 - INTELLECTUAL PROPERTY

The catalogue descriptions, photographs, text and design on this website are our property or are used with permission, and are protected by copyright and other intellectual property laws.

You may read, print and store this material for your own use, and you may quote from it with attribution for the purposes of research, private study, criticism, review and reporting, as permitted by law. Librarians, cataloguers and researchers are welcome to cite our descriptions.

You may not republish our descriptions or photographs as your own, or use them to advertise the same or a similar book for sale, without our written permission. Shopify's name and logo are trademarks of Shopify. Other names and marks belong to their respective owners.

SECTION 7 - THIRD-PARTY LINKS

This website may link to websites operated by others. We are not responsible for their content or accuracy, and following such a link is at your own risk. Please read the terms and privacy policies of any website you go on to use.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

This website is hosted by Shopify, which enables us to provide it to you. Any sale is made directly with Towers Rare Books, and Shopify is not a party to it and is not responsible for it. Nothing in this section affects any claim you may have against us.

SECTION 9 - PRIVACY

Personal information you give us, and information collected automatically when you visit this website, is handled as described in our Privacy Policy. Because the website is hosted by Shopify, some of that information is also processed by Shopify. Please read the Privacy Policy before writing to us.

SECTION 10 - ERRORS AND OMISSIONS

Occasionally this website may contain a typographical error, an inaccuracy or an omission, including in a description, a price or the availability of a book. We may correct any such error and update the website at any time without prior notice.

If an error is material to a sale we have already confirmed, we will tell you at once, and you may withdraw from the sale and be refunded in full. If a book turns out to be materially not as described, our undertaking in Section 3 applies.

SECTION 11 - ACCEPTABLE USE

You may use this website for lawful purposes only. You must not use it to break the law; to infringe our rights or anyone else's; to harass, abuse, defame or threaten any person; to send advertising, spam or chain messages; to impersonate anyone; to transmit any virus or malicious code; to attempt to gain unauthorised access to the website or the systems behind it; or to interfere with anyone else's use of it.

We may restrict or withdraw access to the website from anyone who does any of these things.

SECTION 12 - SEARCH ENGINES, CRAWLERS AND AI ASSISTANTS

This catalogue is published so that it can be found. Search engines, research crawlers and AI assistants are welcome to access, index, quote and cite the public pages of this website, including our descriptions and prices, and to answer a reader's question by pointing them here. We ask only that our descriptions be attributed to Towers Rare Books and, where a price or a condition statement is quoted, that it be quoted accurately and with a link to the page it came from.

Automated access should respect our robots.txt file and should not place an unreasonable load on the website. Automated systems must not attempt to conclude a purchase, and cannot do so: a contract is formed only by our written confirmation to a person, as set out in Section 3. Nothing in Section 11 is intended to prohibit ordinary indexing or citation of this catalogue.

SECTION 13 - DISCLAIMER

The general information on this website, as distinct from the catalogue description of a book we are offering, is provided for information only, and we do not warrant that it is complete or up to date.

We do not promise that the website will always be available or free from error, and we may suspend or withdraw it at any time.

Nothing in this section affects your statutory rights as a consumer under the Consumer Rights Act 2015, including the right to goods that are as described, of satisfactory quality and fit for purpose, or our undertaking that every book is as we describe it.

SECTION 14 - LIABILITY

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by the Consumer Rights Act 2015 about title, description, satisfactory quality and fitness for purpose, and for any other liability that cannot be excluded or limited under the law of England and Wales.

Subject to that, we are not liable for loss or damage that was not foreseeable at the time the contract was made, and where you are buying in the course of a business we are not liable for loss of profit, loss of business, business interruption, or loss of business opportunity, and our total liability in connection with a sale is limited to the price paid for the book.

SECTION 15 - INDEMNITY

If you use this website in breach of Section 11, and we suffer loss or a third-party claim as a result, you agree to reimburse us for that loss and for our reasonable legal costs. This section does not apply to anything arising out of a sale to you, and does not apply to you as a consumer buying a book.

SECTION 16 - GENERAL

If any provision of these terms is found to be unlawful or unenforceable, the rest continues to apply. If we do not insist that you do something you are required to do, or delay in taking steps against you, that does not mean we have given up any right.

These terms, together with the policies referred to in them and any written confirmation we send you, form the whole agreement between us in respect of a sale.

You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours, but not in a way that reduces the rights you have under a sale we have already confirmed.

The headings in these terms are for convenience and do not affect their meaning.

SECTION 17 - GOVERNING LAW

These terms, and any contract formed under them, are governed by the law of England and Wales, and you and Towers Rare Books submit to the non-exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in Scotland or Northern Ireland, nothing in this section removes the protection of the mandatory consumer law of your home nation, and you may bring proceedings in your local courts.

SECTION 18 - COMPLAINTS

If you are dissatisfied with anything, please write to us at towersmacro@gmail.com in the first instance and we will do our best to put it right. We aim to respond within two working days.

We are not a member of a trade association and we do not subscribe to an alternative dispute resolution scheme. If we cannot resolve a complaint between us, you remain free to take the matter to court, and a consumer may wish to take advice from Citizens Advice first.

SECTION 19 - CHANGES TO THESE TERMS

You can read the current version of these terms on this page at any time. We may update them, and the version in force when we send you a written confirmation is the version that governs that sale. A later change does not affect a sale we have already confirmed.
